Terms & Conditions

1. General
The services provided by Workspace365 may change at its discretion at any time during the Agreement. Services are provided during normal business hours Monday to Friday, excluding public holidays and as well as the days between Christmas day until the first business day after New Year, or at other times as negotiated. Clients will pay all charges provided by Workspace365 at the rate indicated by Workspace365. Workspace365 has the right to change these charges by giving one months’ notice in writing. Payment of invoice is due on the 1st of the month, late charges may apply at the cost of $25+GST. Should account be in arrears in excess of 2 weeks (10 working days) your Agreement may be terminated without further notice. A re-connection fee of $140+GST will apply. Clients may not solicit the employment of Workspace365 staff during their time with Workspace365, nor 12 months after ending the Agreement. In the event that a staff member takes employment with a client, the client must pay an introduction fee of 35% of the new actual wage. The client should not make unreasonable demands on the services and staff of Workspace365. The client will not abuse or mistreat (verbally or otherwise) any staff members. A security deposit of 2 months membership is to be held. The client will be charged a once off set up fee of $100+GST. Telephone calls and any other member services incurred at any of our locations will be billed monthly. To terminate your Agreement you must give 2 month's written notice, which must be given at the end of the term. Credit cards and direct debits will be debited in advance on the 1st day of the preceding month automatically. To formalise the service, Workspace365 requires you to complete a 100 point check – i.e. copy of a current photo identification (passport or driver’s license), and a Medicare or credit card, bank statement or utilities bill, and a fully refundable security deposit plus the signed Workspace365 License Agreement. 
All Members and their guests agree to comply with Workspace365 'Community Guidelines' which can be found on our website via the client portal.

Security Deposit
On execution of this Licence the Licensee will pay to the Licensor the security deposit. The Licensor will return the security deposit within 60 days from the later of end of the term from the date the last invoice is paid in full.

2. Go-Virtual - Business Address Membership
Mail will be processed as per instructions provided to workspace365 and can either be automatically forwarded (charges apply) or held for collection Monday to Friday during Centre business hours. Letters are held at your mailing address centre. You will be notified via email when parcels arrive. Collection must be made within 24 hours otherwise parcel storage charges apply. Forwarded mail incurs an envelope charge and postage fee. With written authority mail can also be screened and forwarded via scan/email - charges apply. Business Lounge access is limited to 2 days, pcm. Meeting room bookings will be at member rates. Invitations to member events and access to member specials included.

3. Go-Virtual - Phone Answering Membership
Includes a dedicated telephone number, and messages emailed and sent in real time to a maximum of 4 contacts within client organisation (i.e. name, email/SMS, telephone etc.). Additional contacts can be added to your organisation for a fee of $15.00 per month per contact and changes to your initial set up are $15.00 per amendment. This package includes up to 100 incoming calls pcm. non-cumulative or transferrable, Over 100 calls pcm. may incur additional charges. Meeting room bookings will be at member rates. Invitations to member events and access to member specials included.

4. Go-Virtual - Gold Membership
In addition to the products and services within the Go-Virtual Business Address and Go-Virtual Phone Answering memberships above, this membership also includes 2 days of business lounge access, 2 days of flexi desk usage pcm. These are non-cumulative or transferrable. Meeting room bookings will be at member rates. Invitations to member events and access to member specials included

5. Go-Virtual - Platinum Membership
In addition to the products and services offered within the Go-Virtual - Gold Membership, and the Go-Virtual - Platinum Memberships also includes 2 days access to a private office in any of our locations dependant on availability. Invitations to member events and access to member specials included.

6. Go-Virtual - National Business Address Membership
In addition to the products and services within the Go-Virtual Business Address Membership, the Go-Virtual - National Business Address Membership includes a total of 3 addresses – you may select 1 address from each state (New South Wales, Victoria, Queensland). This membership also includes up to 2 days of business lounge access, per calendar month non-cumulative or transferrable. Meeting room bookings at member rates. 7. Go-Virtual - Business Lounge Membership
The Go-Virtual - Business Lounge Membership includes 5 days ($59/pcm.) or 20 days ($99/pcm.) per month facilitates access to any business lounge or you may purchase a Day Pass at $50+GST. Hours not used are forfeited. It is the client’s responsibility to track hours used within the membership. Should the client’s usage extend beyond the membership’s allocated hours, the client will be charged the relevant hourly rate. Please note business lounge member access is provided on the above terms and may be cancelled by authorised workspace365 staff at any time. Guest passes are available upon request for a daily fee. Should an unauthorised guest access the lounge without observing proper check-in procedures, Workspace365 reserves the right to charge the non-member daily rate of $50+GST. 8. Day Office & Flexi Desk Memberships
  • If you have purchased a 5 x Day Office Membership, you are entitled to; 5 x full days usage of an office pcm. during your Centres opening hours. To redeem your office for the day, please book this via our online portal or have your Centre Team book for you - these offices are based on availability. Note that the office size included with this package, accommodates up to 3 people. Any extra people, will incur a daily charge of $80+GST per person.
  • If you have purchased a 10 x Day Office Membership, you are entitled to; 10 x full days usage of an office pcm. during your Centres opening hours. To redeem your office for the day, please book this via our online portal or have your Centre Team book for you - these offices are based on availability. Note that the office size included with this package, accommodates up to 3 people. Any extra people, will incur a daily charge of $80+GST per person.
  • If you have purchased a 5 x Day Flexi Desk Membership, you are entitled to; 5 x full days usage of a flexi desk pcm. during your Centres opening hours, this is redeemed via booking the desk via the online portal, or contacting your Centre Team directly so they can assign a desk for you and subject to availability.
  • If you have purchased a 10 x Day Flexi Desk Membership, you are entitled to; 10 x full days usage of a flexi desk pcm. during your Centres opening hours, this is redeemed via booking the desk via the online portal, or contacting your Centre Team directly so they can assign a desk for you and subject to availability.
  • If you have purchased a Unlimited Flexi Desk Membership, you are entitled to; full days usage of a flexi desk pcm. during your Centres opening hours, this is redeemed via booking the desk via the online portal, or contacting your Centre Team directly so they can assign a desk for you and subject to availability.

9. Meeting Rooms, Day office, Flexi Desk Rentals
A 24 hour cancellation policy is in place for all meeting room, day office, and flexi desk bookings. Should clients cancel within less than 24 hours’ notice from the time of booking Workspace365 reserves the right to charge the full amount of the booking. Booking cancellations must be received either online or in writing. Services Booking outside of standard office hours require a deposit of 50%. New clients booking outside of office hours must come in person and provide a Photo ID, deposit and meet with a customer service specialist prior to their booking. The expectation is that professional business services will be conducted within Workspace365 premises. workspace365 has the right to cancel the booking and advise the appropriate authorities if professional business conduct is not observed. If the client exceeds the booking time, the client will be charged the prevailing hourly rates. Please kindly remove all your paper/office products, wipe the boards down and leave the office in its original state otherwise an admin fee of $17 per 15 minutes would be charged. Workspace365 staff will refill the water jug/glasses and wipe down the tables. Please note the common areas, business lounge as well as entry to and from the ground level lobby doors are monitored via cameras.

10. Mutual Obligations
Workspace365 and the Client shall keep the terms and conditions of this arrangement confidential and shall not disclose any information relating to these terms and conditions to any third party, unless the consent of the other is first obtained in writing and if the premises of Workspace365 for any reason beyond the control of the parties becomes unfit for use or occupation, in this situation either party can terminate this arrangement immediately by notice in writing from one to the other, without compensation payable between them.

11. Assignment
Workspace365 may assign its rights and obligations under this agreement to a third party without the consent of the client, while the client may only assign his rights and obligations with the consent of Workspace365 in writing.

12. Indemnity
The client must and does hereby indemnify and release workspace365 from all claims against Workspace365 in relation to the client and/or any employee, servant, agent and/or invitee of the client for any loss, damage or consequential loss incurred by the client from the provision of any of the services provided by Workspace365.

13. Holding Over
If the Licensee holds over after the expiration or sooner determination of the Term with the consent of the Licensor, the Licensee will become a monthly licensee of the Licensor and pay a monthly licence fee equal to the monthly fee instalment which was payable at the expiration or sooner determination of the Term. The terms and conditions of otherwise set out in this Agreement will continue to apply.

14. Invoicing
Rental invoices in advance and services in arrears will be sent on the 3rd week of each month.
Invoices will be e-mailed directly to you or your finance department, as per your contact details. The amount owing for rental and service charges, will be paid by the client by way of authorising Workspace365 to charge the client’s nominated credit card or direct debit account on the 1st business day of each month.

It is your responsibility to ensure that:
There are sufficient clear funds in your account to allow a payment to be made. Otherwise, late payment charges will apply. We will need to be advised in writing if the nominated account is transferred or closed. You will pay your Workspace365 monthly rental fee and service charges by an alternate method if the credit card transaction is declined. If your payment is declined by your financial institution you will be charged a fee of $20.00+GST for this failed transaction. Your Agreement may be terminated for non-payment of invoices and a re-connection fee of $140+GST will apply. In the event your overdue account is referred to a collection agency and/or law firm, you will be liable for all additional costs to collect the full debt, including legal demand costs.

15. Credit Card and Direct Debit Transactions
Workspace365 uses Stripe/NAB/ANZ and multiple other gateways to process payments. All transactions are processed via a secure gateway and any outside party cannot view your bank details; payments are fully automated with an immediate response. All transactions are performed under a 128-bit SSL Certificate. All transaction data is encrypted for storage. Surcharges apply.

Glossary
Day Office: Access to a private office (up to 2 persons) subject to availability. If no availability an alternative location nearby can be arranged. Access to tea and coffee facilities and unlimited business grade internet. Access available within standard business hours.
Flexi Desk: Access to a desk within shared space community. Access to tea and coffee facilities and unlimited business grade internet. Access available within standard business hours.
Business Lounge: Access to an open plan area that provides seating, access to tea and coffee facilities and unlimited business grade internet. Access available within standard business hours.
Home Centre: The centre which you have signed your Licence Agreement at.

WS365 VIC use NAB Transact workspace365 uses the Stripe Payment Gateway for its online credit card transactions. Stripe processes online credit card transactions for thousands of Australian merchants, providing a safe and secure means of collecting payments via the Internet. All online credit card transactions performed on this site using the Stripe gateway are secured payments. Payments are fully automated with an immediate response.

  • Your complete credit card number cannot be viewed by workspace365 or any outside party.
  • All transaction data is encrypted for storage within eWAY’s bank-grade data centre, further protecting your credit card data.
  • Stripe is an authorised third party processor for all the major Australian banks.
